since 1980.( Chinese license Number: L-ZY-GJ00071, IATA
Number:08000471, PATA Number:300, ASTA Number:900100347). Having
its registered office address at No. 5, Dongzhimen South Avenue, Dongcheng
District, Beijing, China, and our agreement with you sets out what you are
legally entitled to expect from us when you buy our travel services.
Those travel services are as advertised by us but may also have
restrictions which should be read carefully. Because we sell wide variety
of travel products, you should ready our terms and conditions carefully
before you book, to see if they affect your specific travel arrangements
made by us.
By submitting us to confirm your reservation, you are accepting on
behalf of all persons traveling on this booking that the terms and
conditions, which incorporate the information, restriction and
obligations, constitute the entire agreement between us with regard to
your booking and your travel arrangement. You also consent to proceed with
our policy of privacy and security, reservation and payment, cancellation
and refund.
1. What is City Breaks?
City Breaks offer you more than 50 single-destination
tours in China including Private City Package, Private Day Tour
and Seat-in-Coach Day tour.
Private City Package includes the follow components
offering comfortable stay with unbeatable value of price:
*Transfers
and transportation in the city with air-conditioned private car/tour bus
service as specified in the itinerary
*Hotel Accommodation
as specified in the itinerary
*Chinese or western Meals as specified in
the itinerary
*Professional tour guide and driver
*Sightseeing
program with entrance fees as indicated
Private Day Tour includes the follow components
offering you the comfortable day trip with unbeatable value of
price:
*Hotel pick-up and drop-off service and transportation in the
city with air-conditioned private car/tour bus service as specified in the
itinerary
*Chinese or western Meals as specified in the
itinerary
*Professional tour guide and driver
*Sightseeing program
with entrance fees as indicated
*the tour guide will contact you the
day before the tour to confirm the pick-up time and venue.
Seat-in-Coach Day Tour includes the follow components
offering you the well-organized day trip shared with others in the same
car/tour bus:
*Hotel pick-up and drop-off service and transportation in
the city with air-conditioned car/tour bus shared by others as specified
in the itinerary
*Chinese or western Meals as specified in the
itinerary
*Professional tour guide and driver
*Sightseeing program
with entrance fees as indicated
*the tour guide will contact you the
day before the tour to confirm the pick-up time and venue.
2.Reservations for City
Breaks
Whether you book alone or as a group, we will only
deal with the lead booking name in all subsequent correspondence,
including changes, amendments and cancellations. You must be over 18 years
old and possess the legal capability and authority to book as the lead
name and travel on holidays with us. You are responsible for ensuring the
accuracy of the personal details or any other information supplied in
respect of yourself and any other persons traveling on the booking and for
passing on any information regarding the booking or any changes made in
relation hereto, to all persons traveling on such booking, including but
not limited to information on schedule changes or copies of booking
confirmation.
It is a condition of your booking with us that you and all other
members of your party, including infants and children, are adequately
insured on holiday.
Any persons who is under 18 years old must be accompanied by an adult
on his or her journey.
We strongly recommend you place your booking as early as possible for
your own benefit when we have enough time to deal with the payment ,
change and cancellation.
Reservation should be made at least 24 hours prior to your
arrival date in China*. We will instantly confirm your reservation online
and send confirmation letter to your e-mail address
instantly.
*Reservation for Yangtze River Cruise should be
made with full payment at least 30 days prior to your arrival date in
China.
If any details on the confirmation letter is not correct or complete
tell us immediately. If there is an obvious error on the confirmation
letter we reserve the right to correct it as soon as we become aware of
it.
Reservation within 24 hours prior to your arrival date in
China should be made only by e-mail or phone call and the reservation may
be accepted or confirmed by e-mail with tour quote based on
availability.

3.Payments for City
Breaks
Before you place a booking all prices we advertise
are accurate at the date of published, but we reserve the right to change
any of those prices from time to time in accordance with the change of
itinerary and services. The Prices can go up or down. You will be able to
find and see the updated price of your chosen tours before submitting your
booking.
After you receive the confirmation letter, any increase of the tour
price will be absorbed by ChinaTravelDepot of supplying your tours
resulting from transportation charges(transport charges which form part of
our contract with the transport provider), entrance fees, currency
fluctuations. If any change in our costs would cause a reduction in your
tour price, we will not make any refunds.
We will remind you by e-mail about full payment in order to secure your
reservation. We strongly recommend you complete the full payment as early
as possible so that we can arrange your tours smoothly and nicely.
There is no deposit, however full payment is required to reach
our bank account at least 7 days prior to your tour departure date. Your
reservation is secured only after we have received the full payment on
time.
No Deposit- We do not charge any deposit for
reservation, we stock everything for your interests.
Full Payment: Your punctual full payment is strictly
required to secure your reservation.
For reservation more than 10 days prior to your arrival date in
China: Full payment must be completed at least 10 days prior to your
arrival date in China. Otherwise we will cancel your reservation
automatically by e-mail.*
*Reservation for Yangtze River
Cruise should be made with full payment at least 30 days prior to your
arrival date in China.
For reservation more than 24 hours to 10 days prior to your
arrival date in China: Full payment must be completed within 12 hours
after your reservation is confirmed. Otherwise we will cancel your
reservation automatically by e-mail.
For reservation within 24 hours prior to your arrival date in
China: Full payment must be completed instantly or by the time as
specified in the e-mail after your reservation is confirmed. Otherwise we
will cancel your reservation automatically by e-mail.
Online payment through PayPal :
We strongly
recommend online payment through PayPal which is safer, easier, faster and
free for you ! You can use Visa, MasterCard, American Express, and
Discover to fund your PayPal payments. Plus, when you pay with PayPal, you
do not expose your credit card number to us. Online payment is the best
way to ensure that you pay us and we get paid instantly.
There are three other payment solutions if you have to use:
***Wire
Transfer(bank transfer): subject to bank service charge and it may take
more than 14 days to get your payment. ***Visa/Mastercard/American Express
credit card payment authorization by fax: subject to 4% service charge and
it may take more than 14 days to get your payment.
***Cash either we
come to your address in China or you come to our offices. We do not accept
personal checks.
Once you send the full payment you should inform us by e-mail about the
payment details , which will help us to check the payment due and secure
your reservation for your benefit and interest. If we do not receive the
full payment as we expected or we have reasons to believe that your
payment is delayed and fraudulent, we reserve the right to cancel your
reservation and the cancellation letter will be sent to you by e-mail
properly. We are not responsible for any loss or inconvenience to you if
you fail to access and view the cancellation letter. You can always check
your reservation status at your account on China Travel Depot.
Should you instruct your credit/debit card company to “charge back” any
payment(s) properly due from you in respect of your booking, we will
charge you an administrative fee of USD20 per incident and associated
costs. We further reserve the right to cancel your booking and/or our
office in Canada takes legal action against you for all outstanding
payment(s).
4.Cancellations and Refunds for
City Breaks
If you want to cancel your booking or
part of it, you must advise us in writing to citybreaks@ChinaTravelDepot.com by e-mail or 0086-10-58158822 by fax.. The letter must be signed by the
lead name on the booking and once we receive it you should expect to
receive a cancellation letter within 24 hours. If you do not then please
contact us to ensure your letter has been received.
To cover the cost of processing your cancellation and to compensate us
for the risk that we may not be able to resell your travel arrangements,
we make a cancellation charge on the scale shown below. The person who
made the booking is responsible for paying this charge. The size of the
charge depends on when we receive your cancellation notice or letter or
how you would like us to deal with your payment providing that we have
received your full payment for the tours.
No Cancellation Fees if written cancellation notice is
received more than 30 days after we have received your full payment !

on condition that we keep and transfer the full payment to cover the cost
of your future booking with us for City Breaks/China Tours within 12
months. If your future booking in our updated costs would cause a
reduction against your full payment, we will not make any refunds.
Refund policy
In this event, we will refund any
payment made to us less any cancellation fee , credit card or bank service
charge, currency exchange fees that is applicable within 7 days of our
receipt of your written cancellation request.
5.If we cancel your
reservation
We aim to provide your tours as booked. But we
reserve the right to cancel your reservation if we have reasons to believe
that your payment condition, health conditions may affect us to carry out
the tour arrangements. We will remind you automatically and
continuously about the payment status for the reserved tours by e-mails or
fax. We are not responsible for any inconvenience or loss caused by the
cancellation.
If we cancel your reservation after receipt of your full payment, we
will refund full payment received by China Travel Depot within 14
days.
Please kindly understand that your co-operation for punctual payment
will not only protect your reservation and ticket, but help us to serve
you and more people efficiently and smoothly.
6.If we change your tour
itinerary
We hope that we will not have to make any
changes to your tour itinerary, but because our tours are planned many
months in advance and we sometimes do need to make changes based on the
local situation. We reserve the right to modify the itinerary of your tour
if air schedule or surface transportation changes, and/or events beyond
our control make such alterations necessary.
If you have already booked with confirmation letter from us, we will
let you know as soon as possible. We may offer you hotel/sightseeing
program alternatives in the same or higher standard if the original
service is not available.
Important note-events beyond our control
Events
beyond our control include: war, threat of war, riots, civil disturbances,
terrorist activity, industrial disputes, natural and nuclear disasters,
fire, epidemics, health risks, technical problems with transport including
changes due to rescheduling or cancellation of flights by an airline or
alteration of the airline or aircraft type for reasons beyond our control
or that of our suppliers; closed or congested airports or ports,
hurricanes and other actual or potential severe weather conditions, and
any other similar events.
7. Travel Document
A valid passport and necessary visas or
permits are required for you traveling on our programs. All such
documentation is the sole responsibility of yours, though your travel
consultant may assist you in applying for the necessary travel
documentation upon your request. We accept no responsibility or liability
whatsoever for your failure to obtain appropriate documentation.
8. Medical Issues
You must advise us in writing, at or
prior to booking, of any physical, emotional or mental condition which may
require professional attention during the trip or may require the use of
special equipment. If you require a wheelchair, you must provide your own
small, collapsible wheelchair. Certain features, and certain trips, are
not wheelchair-accessible. We cannot guarantee any wheelchair assistance
or accessibility in international destinations.
We reserve the right
to decline or cancel any trip participant’s reservation whose condition,
in our opinion, may affect the health, safety or enjoyment of you and
other participants.
We cannot accommodate women past their sixth month of pregnancy.
If
you have a condition as contemplated herein, you travel at your own risk.
We are not liable for any injuries, damages you may suffer relating to
such as condition, including without limitation loss of special equipment,
lack of assistance with or accommodation of special needs, and
unavailability of medical assistance or treatment.
You should take into
account all international travel risks and familiarize yourselves with
health requirements applicable to the areas you intend to visit. You are
solely responsible for checking the safety and security conditions,
vaccination, and other health requirements of governments in the
destinations you are going to visit or transit.
Travelers to Tibet are
required to provide a doctor's certificate stating that the he/she is fit
to travel and his/her blood pressure and heart condition are normal in
case that the very high altitude have the possible effects on certain
people.
We are not responsible for the costs of any medical treatment
you may require during the trip. Under no circumstances is China Travel
Depot responsible for the quality of medical care, or lack thereof, you
may receive while on the trip.
9. Travel Insurance
Travel insurance is indispensable for you
while staying and traveling in China and we highly recommend that you
purchase full coverage travel insurance from your country of origin for
your full benefits and travel protections. We are not responsible for any
injury, loss, damage to persons or property when you stay in the
hotels.
We may decline or cancel the hotel reservation if you do not have any
travel insurance from your country of origin.
Please consult the licensed and professional insurance company at your
country of origin before your departure for China for your own benefits
and protection.
10. Complaints and claims
If you have a complaint about your arrangements
during the trip, you must immediately notify the supplier of the service
in question locally. If they are unable to resolve the problem
immediately, you should contact us straight away by telephone/fax/email
and we will endeavor to assist. If you are still not satisfied on your
return home, you must write to our Customer Services within 14 days of
returning from your holiday to allow your complaint to be investigated
properly. Please write your holiday reference number on your letter, and
include your daytime and evening telephone numbers. If you do not give us
the opportunity to resolve any problem locally by reporting it to the
supplier, then we may not be able to deal positively with any complaint on
your return.
11.Our responsibility for your
tours
We will arrange for you to receive the services that
you choose and that we confirm. These services will be provided either
directly by us or through independent suppliers contracted by us. We are
responsible for making sure that each part of the tour you book with us is
provided to a reasonable standard and as was advertised by us, or as
changed and accepted by you. If any part of your tour is not provided as
described and this spoils your holiday, we will pay you appropriate
compensation (see the “Important note-events beyond our control”). Also,
if you buy a local excursion or tour through one of our official
representative or branch office, we will pay you appropriate compensation
if it is not as advertised in our literature.
We have taken all reasonable care to make sure that all the services
which make up the City Breaks advertised by us are provided by efficient
and reputable business. These businesses should follow the local and
national laws and regulations of People’s Republic of China. However, you
should be aware that some standards in China are generally lower than in
the UK, USA and Canada, EU countries.
The responsibility of China Travel Depot and its affiliated companies
are strictly limited. We shall not be responsible for any wrongful or
negligent acts, omissions, or failure to act of any suppliers such as
those of surface, air, and water transportation, sightseeing excursions,
cruise/hotel accommodations, or of any third party not directly owned or
operated by us. By utilizing the travel services of the suppliers, you
agree that you will look to such suppliers for any accident, injury,
property damage, or personal loss to you or to those traveling with you,
and that neither China Travel Depot nor any representative of China Travel
Depot shall be liable.
Without limitation, we are not responsible for any injury, loss, or
damage to person or property, death, delay, or inconvenience in connection
with the provision of, or failure to provide, any goods or services
occasioned by or resulting from—but not limited to—acts of God or force
majeure, acts of war or civil unrest, insurrection or revolt, strikes or
other labor activities, criminal or terrorist activities of any kind,
overbooking or downgrading of accommodations, mechanical or other failure
of airplanes of other means of transportation or for the failure of any
transportation mechanism to arrive or depart on time, sanitation problems,
lack of medical care, or for any other cause beyond our direct control. We
are not responsible for the stolen and lost of your valuable items due to
your own negligence.
We are not responsible for your failure to comply with customs
regulations.
We reserve the right to substitute hotels of similar quality at any
time or to make changes in itinerary of similar quality, flights, or
cruise ships, or to cancel the tour prior to departure.
If we have cancelled any tour after receiving your full payment , we
are liable for a full refund of the money received within 14 days.
If you purchase an airline ticket separately, ensure that you
understand well the conditions under which the ticket is issued as we are
not responsible for such airline ticket cancellation fees.
We
reserve the right to correct promotional or pricing errors at any time, or
to increase the program price in the event of cost increases due to
changes in airfares, cruise fares, currency fluctuations, park fee
increases, taxes, or fuel surcharges before Confirmation Letter is
issued.
Please understand that not all museums and attractions are
open every day of the year. We reserve the right to vary the sequence of
sightseeing and/or to re-route the order of cities if that will enable you
to visit all listed excursions. In either case, the itinerary content will
be maintained to the extent possible and there are no refunds for any
unused or unavailable excursions.
Many of City Breaks include activities that require care attention.
Such activities include boarding and going ashore from boats, climbing
hills and entering and exiting tombs and caves etc. You will receive help
and advice from our official representatives but all activities are
undertaken at your own risk. China Travel Depot, its employees and agents
cannot be responsible for any action or event that occurs after its
employees and agents have exercised their duty and taken the necessary
care.
